Our mission is to facilitate connections between course authors and learners in a user friendly platform.  We aim to connect learner and author in an efficient manner where geography is not a barrier.  We hope that our service will enable anyone to gain access to a variety of services at a time that suits them.

 

We will listen to you.  Our Platform is the product of what you (the users) prefer and find most convenient when using our service

 

We respect your opinions.  We provide uncensored accounts of your experiences and thus help you to contribute to the community feedback

 

 

2. INTRODUCTION

 

These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our (mobile) website or any of our applications through whatever platform (hereafter collectively referred to as the "Platform") and/or by enrolling on an eCourse, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement).

 

These pages, the content and infrastructure of these pages, and the online enrolment service provided by us on these pages and through the website are owned, operated and provided by atlanticcourses.com and are provided for your personal, non-commercial use only, subject to the terms and conditions set out below.  Commercial organisations / entities, are not precluded from using atlanticcourses.com, but do require specific prior permission from us.  This is to ensure high quality, learner centred content, that will benefit the whole community.

 

 

3. DEFINITIONS

 

"atlanticcourses.com", "us", "we" or "our" means the atlanticcourses.com group.  "Platform" means the (mobile) website / app on which the Service is made available, owned, controlled, managed, maintained and/or hosted by atlanticcourses.com. "Session" means the products and services offered by atlanticcourses.com.

 

"Author" means the creator of eCourse information / content (e.g. written information, videos, images, blog, discussion forum), and any other service or related product as is from time to time available on the Platform.

 

"Learner" means any individual or individuals or groups using atlanticcourses.com to gain access to author content.

 

"User" comprises the groups of ‘Author’ and ‘Learner’ and thus comprises all those accessing the atlanticcourses.com Platform.

 

"Enrolment" applies to any eCourse taken / booked through atlanticcourses.com.

 

 

4. SCOPE AND NATURE OF OUR SERVICE

 

Our mission is to facilitate connections between educators (authors) and learners, in a user friendly platform.  To fulfil our mission, we provide the products and services described below to you: 

 

4.1 Provide a tailored experience for you

You are in control of which eCourses you enrol on.  You can cancel your enrolment at any time.

 

4.2 Monitor your experience / progress

Because everyone’s experience is specific to them, you are able to track your progress in any of the quizzes taken, as well as accessing enrolment certificates for courses you are enrolled on.  This helps you see whether you are attaining the goals you want.  You are in control and can make changes that best suit you.

 

4.3 Help you discover content and services that interests

There are no adverts on atlanticcourses.com but you can browse and search eCourses and authors to find a wide array of content. Because the eCourses are remote, you can try out various eCourses without having to invest the time and money to physically visit them.  You can also access the eCourses at a time that suits you.

 

4.4 Combat harmful conduct, and protect and support our users

We want to provide a safe environment for both learners and authors. If we learn of content or conduct that constitutes harmful or abusive conduct towards others, we will take appropriate action – for example, offering help, removing content, disabling an account or contacting law enforcement.

 

4.5 Research ways to make our services better

We engage in research to develop, test and improve our service. This includes analysing the data we have about our learners and authors and understanding how people use our services, for example by conducting surveys and testing and troubleshooting new features. Our policies explain how we use data to support this research for the purposes of developing and improving our services.

 

4.6 Be able to connect you with educators and organisations that you care about

We help you find and connect with eCourses that matter to you.  We may use the data that we have to make suggestions for you and others – for example, forums to join, eCourses to enrol on.  We believe that our services are most useful when people are connected to people, groups and organisations that they care about.

 

 

5. FINANCIALS

 

5.1 How our services are funded

We think it important that there are no costs to join atlanticcourses.com. Furthermore we consider it vital that you have a user friendly experience without being bombarded with advertisement.  Our services are free to individual authors and learners, however some commercial organisations who produce an online course may provide payment to help support the website for the benefit of all.

 

5.2 Enrolments

There is no charge to enrol on a course.

 

 

6. YOUR COMMITMENTS TO OUR COMMUNITY

 

6.1 Who can use atlanticcourses.com
When people stand behind their opinions and actions, our community is safer and more accountable. For this reason, you must: 

    • use the same name that you use in everyday life to sign-up (a nickname / username can be set);
    • provide accurate information about yourself;
    • not share your password, give access to your atlanticcourses.com account to others, or transfer your account to anyone else (without our permission).

 

6.2 Who cannot use atlanticcourses.com

We try to make atlanticcourses.com broadly available to everyone, but you cannot use atlanticcourses.com if: 

    • You are under 16 years old;
    • You are a convicted sex offender;
    • We've previously disabled your account for breaches of our Terms or Policies;
    • You are prohibited from receiving our products, services or software under applicable laws;
    • Commercial organisations, without the specific prior permission of atlanticcourses.com.

 

6.3 What you can share and do on atlanticcourses.com
We want people to use atlanticcourses.com to express themselves and to share content that is important to them, but not at the expense of the safety and well-being of others or the integrity of our community. You therefore agree not to engage in the conduct described below (or to facilitate or support others in doing so).

 

6.4 What you cannot share and do on atlanticcourses.com
You may not use our services to do or share anything: 

  • That breaches these Terms, our Community Standards and any other terms and policies that apply to your use of atlanticcourses.com.
  • That is unlawful, misleading, discriminatory or fraudulent.
  • That infringes or breaches someone else's rights, including their intellectual property rights.
  • You may not upload viruses or malicious code, or do anything that could disable, overburden or impair the proper working or appearance of our services.
  • You may not access or collect data from our services using automated means (without our prior permission) or attempt to access data that you do not have permission to access.

 

We can remove or block content that is in breach of these provisions.  We can also block users / learners / authors who have breached our terms.  If we decide to block you as an author, your course material may still be visible to those people who have enrolled on your courses for a period of up to 12months, although new learners will not be able to enrol.

 

If we remove content that you have shared for breach of our Community Standards, we'll let you know and explain any options that you have to request another review, unless you seriously or repeatedly breach these Terms or if doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, or systems; where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons. 

 

To help support our community, we encourage you to report content or conduct that you believe breaches your rights (including intellectual property rights) or our terms and policies. You can report concerns by using the ‘Report concerns about this eCourse’ button, or by contacting us using our ‘Contact’ page.

 

 

7. PERMISSIONS

 

We need certain permissions from you to provide our services.  These are outlined below.

 

7.1 Permission to use content that you create and share

Some content that you share or upload, such as photos or videos, may be protected by intellectual property laws.

 

You own the intellectual property rights (things such as copyright or trademarks) in any such content that you create and share on atlanticcourses.com. Nothing in these Terms takes away the rights you have to your own content. You are free to share your content with anyone else, wherever you want.  However, to provide our services, we need you to give us some legal permissions (known as a ‘licence') to use this content. This is solely for the purposes of providing and improving our services.  Specifically, when you share, post or upload content that is covered by intellectual property rights on or in connection with our Products, you grant us a non-exclusive, transferable, sub-licensable, royalty-free and worldwide licence to host, use, distribute, modify, run, copy, publicly perform or display, translate and create derivative works of your content. This means, for example, that if you share a photo on atlanticcourses.com, you give us permission to store, copy and share it with others, such as service providers that support our service.  This licence will end when your content is deleted from our systems.

 

7.2 Permission to remove content

You can delete content individually or all at once by deleting your account.  When you delete content, it may still be visible to users who have enrolled on your eCourses.  Once the enrolment finishes it will no longer be visible to other users, however, it may continue to exist elsewhere on our systems where:

  • Immediate deletion is not possible due to technical limitations (if you are concerned that content may breach copyright or have other reasons that content needs to be urgently removed then please get in contact with Atlantic Courses on the contact provided); 
  • Your content has been used by others in accordance with this licence and they have not deleted it (in which case, this licence will continue to apply until that content is deleted); or
  • Where immediate deletion would restrict our ability to:
    • Investigate or identify illegal activity or breaches of our Terms and Policies (for example, to identify or investigate misuse of our Products or systems);
    • Comply with a legal obligation, such as the preservation of evidence; or 
    • Comply with a request of a judicial or administrative authority, law enforcement or a government agency; in which case, the content will be retained for no longer than is necessary for the purposes for which it has been retained (the exact duration will vary on a case-by-case basis). 

 

7.3 Permission to use your name, profile picture and information about your actions with ads and sponsored content

You give us permission to use your name and profile picture and information about actions that you have taken on atlanticcourses.com next to or in connection with ads, offers and other sponsored content that we display, without any compensation to you. For example, we may show a new eCourse that you have created.

 

7.4 Limits on using our intellectual property
If you use content covered by intellectual property rights that we have and make available in our Services (for example, images, designs, videos or sounds that we provide, which you add to content that you create or share on atlanticcourses.com), we retain all rights to that content (but not yours). You can only use our copyrights or trademarks (or similar marks) as expressly permitted by with our prior written permission. You must obtain our written permission (or permission under an open source licence) to modify, create derivative works of, decompile or otherwise attempt to extract source code from us. 

 

 

8. CONTENT

 

8.1 Inappropriate content

While it is important that Authors are free to create an information resource for their Learners, and for Learners to be able to share their experiences and views, it is also important that atlanticcourses.com is a safe and enjoyable community.

 

8.1.1 Hate speech

Hate speech is not allowed on atlanticcourses.com because it creates an environment of intimidation and exclusion, and in some cases, may promote real-world violence. 

 

We define hate speech as a direct attack on people based on what we call protected characteristics – race, ethnicity, national origin, religious affiliation, sexual orientation, caste, sex, gender, gender identity and serious disease or disability. We also provide some protections for immigration status. We define "attack" as violent or dehumanising speech, statements of inferiority, or calls for exclusion or segregation.

 

Sometimes people share content containing someone else's hate speech for the purpose of raising awareness or educating others. In some cases, words or terms that might otherwise violate our standards are used self-referentially or in an empowering way.  In all of these cases, we allow the content but expect people to clearly indicate their intent, which helps us better understand why they shared it. Where the intention is unclear, we may remove the content.

 

We allow humour and social commentary related to these topics. In addition, we believe that people are more responsible when they share this kind of commentary using their authentic identity.

 

8.1.2 Violence and graphic content.

We remove content that glorifies violence or celebrates the suffering or humiliation of others because it may create an environment that discourages participation. We allow graphic content (with some limitations) to help people raise awareness about issues. We know that people value the ability to discuss important issues such as human rights abuses or acts of terrorism. We also know that people have different sensitivities with regard to graphic and violent content. For that reason, we ask eCourse Authors to add a warning to especially graphic or violent content (e.g. graphic surgical procedures) so that people are aware of the graphic or violent nature before they click to see it.

 

8.2 Permission, licences, copyright

Providers are responsible for all content they display, including obtaining any permissions, licences, and relevant copyright for third-party material used.

 

Atlanticcourses.com is not responsible or liable for any third party content or for the accuracy of any content displayed by Authors or comments made by Learners.

 

Atlanticcourses.com is further not responsible or liable for any injury or other adverse event caused to users through advice or information given to them by Authors or other Users.

 

8.3 Intellectual property rights

Unless stated otherwise, the software required for our services, or available at or used by our Platform, and the intellectual property rights (including the copyrights) of the contents and information of and material on, our Platform are owned by atlanticcourses.com or it’s eCourse Authors.

 

Atlanticcourses.com exclusively retains ownership of all rights, title and interest in and to (all intellectual property rights of) the look and feel (including infrastructure) of the Platform on which the service is made available (including the guest reviews and translated content) and you are not entitled to copy, scrape, (hyper- /deep) link to, publish, promote, market, integrate, utilise, combine or otherwise use the content (including any translations thereof and the guest reviews) or our brand without our express written permission. To the extent that you would (wholly or partly) use or combine our (translated) content (including guest reviews) or would otherwise own any intellectual property rights in the Platform or any (translated) content or guest reviews, you hereby assign, transfer and set over all such intellectual property rights to atlanticcourses.com. Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our intellectual property rights (including copyright and database right).

 

eCourse authors retain copyright over their material.  They have control over their content, although where learners are enrolled on eCourses, the eCourse cannot be removed until the enrolment period is over.  Authors can however prevent further learners from enrolling.

 

8.4 Content security

Atlantic courses takes precautions to prevent the loss of data uploaded onto (for example images, documents, audio files, video links, and slideshow files) and created on (for example quizzes, profile content, course description content, questions & answers), or by (for example ratings, questions, past quiz scores) the site.  However Atlantic courses takes no responsibility for loss of such data and it is up to the user / learner / author to ensure suitable back-ups are available in the event that data is lost or corrupted on the website servers.

 

 

9. ACCOUNTS

 

9.1. Sign-up

Users are required to agree to the terms and conditions of atlanticcourses.com in order to sign-up.  Once signed up, Users can gain access to Author content through enrolment on courses.

 

9.2 Account suspension or termination

We want atlanticcourses.com to be a place where people feel welcome and safe. 

 

If we determine that you have clearly, seriously or repeatedly breached our Terms or Policies, we may suspend or permanently disable access to your account. We may also suspend or disable your account if you repeatedly infringe other people's intellectual property rights or where we are required to do so for legal reasons. 

 

Where we take such action, we'll let you know and explain any options you have to request a review, unless doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems or Products; where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons. 

 

If you think that we have disabled your account by mistake then please get ion contact with us using the ‘Contact’ page of atlanticcourses.com.

 

If you delete, or we disable your account, content you have created may still be visible as outlined above.

 

Atlanticcourses.com is entitled to terminate their relationship with Users for whatever reason.

 

Users may terminate their relationship with atlanticcourses.com by deleting their account

 

Course Authors may terminate their relationship with atlanticcourses.com by deleting their account once the Learners enrolled on their courses has reached zero. Course authors can stop additional Learners enrolling at any time.

 

9.3 Deactivation

Users may delete their account at any point.  On doing so they will no longer have access to their account information, or any saved progress or other information saved to their account.  Their enrolments will terminate with immediate effect.  It will not be possible to reinstate their account but they may create a new account provided account deactivation was not connected to any inappropriate account use.

 

Course authors may deactivate their account once they have no users enrolled.  If they deactivate their account while users are still enrolled on their eCourses, then those eCourses with enrolled users will remain open until enrolment finishes at 12months or less from the time of enrolment.

 

 

10. RANKING, USER REVIEWS AND STARS

 

The default setting of the ranking of providers on our Platform is created through a complex ever changing and evolving system (algorithm) that considers a multitude of criteria in order to match searchers and eCourses in an optimal way. The actual ranking will be different for each eCourse / Author and for each search as there are many criteria included, for example the eCourse content, or specific Author attributes.

 

eCourse star rating displayed on atlanticcourses.com is not determined by atlanticcourses.com. The Learners determine the eCourse star rating.  Only Learners enrolled on a course will be invited by atlanticcourses.com to comment on their experience. The completed review (including submitted rating) may be (a) uploaded onto the relevant Course information page on our Platform for the sole purpose of informing (future) Users of their opinion of the service, and (b) (wholly or partly) used and placed by atlanticcourses.com at its sole discretion (e.g. for marketing, promotion, or improvement of our service) on our Platform or such social media platforms, newsletters, special promotions, apps, or other channels owned, hosted, used, or controlled by atlanticcourses.com and our business partners. In order to offer and maintain recent (and therefore relevant) reviews, we may enable reviews to only be submitted within a limited period of time after enrolment and it may be that each review is only available for a limited period of time after posting. The default ranking of the reviews is by date of submission relative to a few additional criteria (e.g. language, reviews with comments).  Atlanticcourses.com does allow the eCourse Author to respond to a review. We reserve the right to adjust, refuse, or remove reviews at our sole discretion insofar as it violates our review policy.  Atlanticcourses.com does not compensate or otherwise reward a customer for completing a review. The Learner review should be regarded as a survey and does not include any (further commercial) offers, invitations, or incentives whatsoever.  Atlanticcourses.com undertakes to use its best efforts to monitor and remove reviews that include obscenities or other inappropriate content.

 

Atlanticcourses.com will not accept reviews which include:

  • Profanity, sexually explicit, hate speech, discriminatory, threats, violence, personal attack towards the staff
  • Promotion of illegal activities (e.g. drugs, prostitution)
  • Sites, emails and addresses, phone numbers, cc details
  • Politically sensitive comments

 

 

11. DISPUTES

 

We try to provide clear rules so that we can limit or hopefully avoid disputes between users and between users and us. If a dispute does arise, then please do get in contact with us as soon as possible using the 'Contact' page of the atlanticcourses.com website so that we can help resolve it. 

 

12. PERSONAL DATA

 

We use your personal data, such as information about your activity and interests, to improve our service.

 

We do not sell your personal data.

 

We don't share information that directly identifies you (information such as your name or email address that by itself can be used to contact you or identifies who you are) unless you give us specific permission.

 

 

13. ADDITIONAL PROVISIONS

 

13.1 Updating our Terms
We work constantly to improve our services and develop new features to make our Products better for you and our community. As a result, we may need to update these Terms from time to time to accurately reflect our services and practices. We will only make changes if the provisions are no longer appropriate or if they are incomplete, and only if the changes are reasonable and take due account of your interests. 

 

We will notify you (for example, by email or through our Products and Services) at least 30 days before we make changes to these Terms and give you an opportunity to review them before they go into effect, unless the changes are required by law. Once any updated Terms are in effect, you will be bound by them if you continue to use our Products. 

 

We hope that you will continue using our Products, but if you do not agree to our updated Terms and no longer want to be part of the atlanticcourses.com community, you can delete your account at any time. 

 

13.2 Limits on liability
Nothing in these Terms is intended to exclude or limit our liability for death, personal injury or fraudulent misrepresentation caused by our negligence, or to affect your statutory rights. 

 

We will exercise professional diligence in providing our Products and Services to you and in keeping a safe, secure and error-free environment. Provided that we have acted with professional diligence, we do not accept responsibility for losses caused by users breaching our Terms; losses that are not reasonably foreseeable by you and us at the time of entering into these Terms; and events beyond our reasonable control. 

 

13.3 Other
These Terms make up the entire agreement between you and atlanticcourses.com regarding your use of our Platform. They supersede any prior agreements.

 

If any portion of these Terms is found to be unenforceable, the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, it will not be considered a waiver. Any amendment to or waiver of these Terms must be made in writing and signed by us.

 

You will not transfer any of your rights or obligations under these Terms to anyone else without our consent.

 

You should know that we may need to change the username for your account in certain circumstances (for example, if someone else claims the username and it appears unrelated to the name that you use in everyday life). We will inform you in advance if we have to do this and explain why.

 

We always appreciate your feedback and other suggestions about our Platform. But you should know that we may use them without any restriction or obligation to compensate you, and we are under no obligation to keep them confidential.

3.2 Sharing / posting reviews and replying to them

For those Users who are enrolled on an eCourse they will have the opportunity to provide a review rating as well as comments.  eCourse authors will be able to reply to such comments.  This information will be seen by anyone, on or off our Platform, including if they don't have an account. This information may also be seen, accessed, re-shared or downloaded through third-party services such as search engines, APIs and offline media such as TV, and by apps, websites and other services that integrate with our Platform.

 

3.3 Apps, websites and third-party integrations on or using our Products.

When you choose to use third-party apps, websites or other services that use, or are integrated with, our Products, they can receive information about what you post or share.  Information collected by these third-party services is subject to their own terms and policies, not this one. 

 

3.4 New owner.

If the ownership or control of all or part of our Products or their assets changes, we may transfer your information to the new owner. 

 

3.5 Sharing with third-party partners

We may work with third-party partners who help us provide and improve our Platform but will not sell any of your information to anyone.
